Federal Court Orders Freedom of Abrego Garcia from ICE Detention

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.

The situation originates in a erroneous removal to El Salvador in March, which the government later admitted was an error. Following his repatriation to the United States to face alien smuggling charges, he was held in federal custody.

In her order, the court pointed out that the authorities does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

The legal challenge involve conflicting assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.

He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing trial in the state of Tennessee.
